What is a contract of employment?
A contract of employment is an agreement between an employer and an employee.
The contract is made as soon as an employee accepts a job offer, and both sides are then bound by its terms until it’s properly ended (usually by giving notice) or until the terms are changed (usually by mutual agreement).
What are the Statement of Terms of Employment?
The employees rights and duties, and those of the employer, are called the ‘terms' of the contract. The contract doesn’t have to be in writing, but your staff are entitled to a written statement of the main terms within two months of starting work.
The document is only legally binding if what is in it is legal...i.e you can not make up your own rules !
If you choose to not provide your staff with a contract of employment, you will find that they are still covered by the law, but it is in your benefit to ensure that they are aware of what they should and shouldn't do whilst they are employed by you.
